{"id":534333,"date":"2026-10-05T11:31:37","date_gmt":"2026-10-05T09:31:37","guid":{"rendered":"https:\/\/masachs.com\/la-nova-llei-derradicacio-de-lamiant-que-canvia-per-als-propietaris"},"modified":"2026-10-05T12:43:37","modified_gmt":"2026-10-05T10:43:37","slug":"new-asbestos-eradication-law","status":"publish","type":"post","link":"https:\/\/masachs.com\/en\/new-asbestos-eradication-law","title":{"rendered":"The new asbestos eradication law: What changes for property owners"},"content":{"rendered":"<p dir=\"ltr\">On <strong>3 October 2026<\/strong>, Catalonia&#8217;s <a href=\"https:\/\/www.boe.es\/boe\/dias\/2026\/08\/17\/pdfs\/BOE-A-2026-17836.pdf\" target=\"_blank\" rel=\"noopener\">Law 8\/2026<\/a> on the Eradication of Asbestos comes into force, a piece of legislation that brings <strong>new obligations for property owners<\/strong>.<\/p>\n<p dir=\"ltr\">At Masachs Industrial, we want to explain clearly what the new law establishes and how it may affect you.<\/p>\n<h2 dir=\"ltr\">What is the new obligation for property owners?<\/h2>\n<p dir=\"ltr\">One of the central elements of the law is the creation of <strong>a specific certificate<\/strong> confirming whether or not visible asbestos has been detected in a property.<\/p>\n<p dir=\"ltr\">This document will be <strong>mandatory when selling or letting a property<\/strong>.<\/p>\n<h2 class=\"p1\">Why this law?<\/h2>\n<p dir=\"ltr\">Asbestos was a material widely used in construction for decades, but we now know that exposure to its fibres can pose serious health risks.<\/p>\n<p dir=\"ltr\">The European Union recommends moving towards the complete removal of this material from buildings by the end of 2032.<\/p>\n<h2 class=\"p1\">Which properties does it affect?<\/h2>\n<p class=\"p1\">The obligation affects <strong>all types of property located in Catalonia<\/strong>, including <strong>homes, commercial premises, industrial units and undeveloped land, whenever a sale or other transaction involving payment takes place<\/strong>.<\/p>\n<h2 class=\"p1\">What must the certificate state?<\/h2>\n<p dir=\"ltr\">The law establishes that <strong>the certificate must include<\/strong>, as a minimum, information on:<\/p>\n<ul dir=\"ltr\">\n<li>The presence or absence of visible asbestos.<\/li>\n<li>The condition of any materials containing it.<\/li>\n<li>The risk these materials may pose to people.<\/li>\n<\/ul>\n<p dir=\"ltr\">It is important to bear in mind that the certificate refers to visible asbestos at the time of inspection and does not guarantee that there is no hidden asbestos.<\/p>\n<p dir=\"ltr\">Until this regulation is approved, the Catalan Waste Agency (Ag\u00e8ncia de Residus de Catalunya) has published <a href=\"https:\/\/residus.gencat.cat\/ca\/ambits_dactuacio\/tipus_de_residu\/amiant\/model_certificat\/index.html\" target=\"_blank\" rel=\"noopener\">a basic certificate template<\/a> that can be used during this transitional period.<\/p>\n<p dir=\"ltr\">In addition, both the certificate and any grants or subsidies obtained must be recorded in the corresponding registers.<\/p>\n<h2 dir=\"ltr\">What happens if the certificate is not provided?<\/h2>\n<p dir=\"ltr\">The absence of this certificate may affect how the transaction proceeds and complicate subsequent registration procedures.<\/p>\n<h2 dir=\"ltr\">Who can issue this certificate?<\/h2>\n<p dir=\"ltr\">It is still to be determined by regulation <strong>which persons, professionals or entities will be authorised to issue it<\/strong>. Correct identification makes it easier to market the property and helps avoid issues during the sale or letting process.<\/p>\n<h2 dir=\"ltr\">Frequently asked questions<\/h2>\n<p dir=\"ltr\"><strong>Do I need to know whether my unit contains asbestos?<\/strong><br \/>\nYes. The owner must be aware whether asbestos-containing materials are present in the property.<\/p>\n<p dir=\"ltr\"><strong>Where is asbestos usually found?<\/strong><br \/>\nIn fibre-cement roofing, downpipes, tanks, panels, insulation and other older building elements.<\/p>\n<p dir=\"ltr\"><strong>Can I sell or let a unit that contains asbestos?<\/strong><br \/>\nYes, but its presence must be properly disclosed by means of the relevant certificate.<\/p>\n<p dir=\"ltr\"><strong>Which properties may contain asbestos?<\/strong><br \/>\nIn Spain, the manufacture, import and sale of asbestos-containing materials was banned in 2002. Therefore, any property built or refurbished before that date may contain elements with asbestos, whether it is an industrial unit, a commercial premises, an office building or a home.<\/p>\n<p dir=\"ltr\"><strong>Does this only affect industrial units?<\/strong><br \/>\nNo. Asbestos can be found in many types of property.
